and politically. it's the first setback obama has had. he has been riding high on everything. victory after victory. this is an important setback. it's likely to temper their pension for ruling through executive orders. and by administrative actions. to go around congress. this is a rebuke. saying that we were saying at the time. these are lawless appointments. the senate was not in recess. >> bret: explain this. thenate was in a pro forma session. the republicans kept it in pro forma session. they were doing some things. they were moving some things along. some things were moving through. it wasn't a full session. democrats were refuting that. the president said they were re -- the president said they were recess appointments and the republicans said we weren't in recess. >> recess appointments look like a power grab and they are. they use them to slip through controversial nominee the other party opposes. george w. bush did it 171 times. clinton, 139. reagan 243 times. this a practice that they use. they figured out how to make fake sessions to seem like the chamber is not in recession. t

of new jersey chris christie. this apparently is zuckerberg's first time hosting a political fund-raiser. tickets $3,800 per person. at this point he hasn't declared a preference for a political party. the facebook founder met with president obama twice including a town hall meeting at facebook. >>> it's gadget friday. scott mcgrew has a cool thing to make your tv cooler than you think. >> i know someone at home, one of our administrators say the tv is backwards. it's supposed to be. you're familiar with internet enabled television. they stream netflix and hulu. you don't have to buy a new television. you can hook up an internet enabled dvd player. manufacturers are shrinking this technology down to this stick. this is a smart stick from a company that is powered by google. there are things like hulu and netflix that you can get. those do require a subscription but they are good services particularly hulu. it's worth it. i want to walk you through the installation process. you take this and find your hdmi port in the back and you do that. that's pretty much it. >> i can do that. >

. this decision said the recess appointments as they have been done not just by president obama, but all presidents in recent decades. they are all unconstitutional. >> sorry this a political decision? >> this is the question that is hard to answer. these are three very conservative republican judges. the political implications of the decision are clear. for a republican anti-democrat and can i say that that was the motivation of the judges? i can't. >> can we assume it's the u.s. supreme court that will consider this or leave it hanging? >> they have to. it's too important of a decision and think the supreme court will take it. >> this is an automatic. >> almost automatic. very difficult to predict because this is an aggressive conservative majority on the supreme court. citizens united and campaign finance. the second amendment and gun control. this court has been aggressively conservative and it could be affirmed by the supreme court. >> what are does it say about president obama? >> the d.c. circuit court of appeals that decided this case often called the second most important court

. i think he is sincere in all this, but he is out there with a dog of an issue politically. he wants to run in 2016 and he is stuck doing this while hillary clinton is going to cohost 60 minutes with barack obama this sunday. i am sure he is very bitter about that. jon: that is why we have the vice president giving helpful device that if you really want to protect yourself, go buy a shotgun. that way he can work both sides of the issue -- push for gun control, but still be an advocate for guns? >> it's not really great advice. while i think a shotgun is good, it's also really good at killing the innocent bystander next to the person raking into your house. the whole thing is that joe biden knows that he can be anti-gun. the problem is that this administration, for good reasons or bad, they have zero credibility with the gun rights community. they believe that dianne feinstein and barack obama wants to take away guns. they believe that in their bones. this legislation is so full of loopholes and wants to lay down a predicate to make it easier down the road to check gun owners and sue
